Family Visas: Applying as an adult coming to be cared for by a relative

if you wish to live in the UK to be cared for by a relative living in the UK, you may apply for a Family Visa.

The UK Immigration Rules allow for adults who need long-term care living overseas, who have British or settled relatives living in the UK, to apply for this visa.

Eligibility Criteria

You meet the eligibility criteria if you:

  • Are above the age of 18 
  • Require long term care due to disability, age or illness
  • Does not have access to adequate care in your country

In addition, your relative must be able to support, accommodate and care for you without claiming public funds for at least 5 years and satisfy one of the criteria listed below:

  • They have a British or Irish citizenship
  • They have indefinite leave to remain, settled status or proof of permanent residence
  • They have a pre-settled status and are from the EU, Switzerland, Norway, Iceland or Liechtenstein 
  • They have refugee status or humanitarian protection in the UK

If your family member has settled status you may be able to apply to the free EU Settlement Scheme

Length of stay

How long you can stay depends on the status of your family member.

If they have a pre settled status, refugee status or humanitarian protection, you can stay as long as your family member stays.

Your stay is unlimited if your family member is British, Irish or settled in the UK.

If you are applying from outside the UK, you should make an application for a visa no more than 3 months before you plan to be in the country

For applications made within the UK, you should make an application for a visa no more than 3 months before your current visa expires.

It takes between 8 to 12 weeks for the Home Office to make a decision on applications from outside the UK following submission. The timeline may currently be longer due to the COVID-19 pandemic.

Priority service is available as an additional purchasing option for applications made within the UK with a decision made in either 5 days or 24-hours depending on the service chosen.

When you are required to extend your stay depends on the status of your family member.

If they have a pre settled status, refugee status or humanitarian protection, you will need to apply to extend or settle when they do.

You will not need to apply to extend or settle if your family member is British, Irish or settled in the UK.
