EU Settlement Scheme: Surinder Singh applications update

The Home Office has confirmed some details regarding ‘Surinder Singh’ applications, following an inquiry regarding family relationships and the EU Settlement Scheme (EUSS).

What is a ‘Surinder Singh’ application?

‘Surinder Singh’ is the name for an EUSS application made by someone who is applying as a family member of a British Citizen. Applicants must have lived with them in an EU country, Switzerland, Norway, Iceland or Liechtenstein before 1 January 2021. Then they must have returned to the UK with them before this date.

What has the Home Office confirmed regarding the EUSS family permit?

All applicants have until 29 March 2022 to return to the UK via the EUSS family permit if you have:

  • A family relationship with a British Citizen that was formed before the UK’s exit out of the European Union (before 1 February 2020); and
  • Had children born or adopted since this time.

Applications to the EU Settlement Scheme must be made before the deadline unless you have reasonable grounds for why the deadline was missed. If the application was made by the deadline but the permit was issued after 29 March 2022, you will have a reasonable excuse for a late application and return to the UK
